About our services

Minimum Age. You must be at least 16 years old to use our Services, unless your national law allows for a different minimum age for the subscription of information society services. If you do not have the minimum age required for agreeing to our Terms of Service, your parent or relevant legal representative must agree to the Terms of Service on your behalf.

Account Registration. To create an account and register for the Treebal Services, you will need to use your mobile phone number. You agree to receive text messages and phone calls (from us or our third-party providers) with verification codes for the purpose of registering to the Treebal Services.

Privacy of User data. To protect the privacy of its users, the Treebal Services feature endto- end encryption so user messages and calls are protected from access by Treebal or other third parties. In addition, Treebal will not sell, rent or monetize your personal data or content without your permission. Provided you consent to it, you will receive communications from collectivities, associations and/or brands. Please check the Treebal Privacy Policy for further details on how we process the data of the users of the Treebal Services.

Software. In order to enable new features and enhanced functionality for the Treebal Services, you acknowledge that downloading and installing updates our mobile application is required.

Fees and Taxes. The use of the Treebal Services requires Internet access. You are responsible for the data and mobile carrier fees that may be applicable and any related taxes associated with your use the Treebal Services on your device.

Using treebal

Our Terms or Service and Policies. Your use of the Treebal Services must comply with our Terms of Service and the related applicable policies. If we disable your account for a violation of our Terms of Service, you may not create another account without our permission.

Acceptable Use. You agree to use the Treebal Services only for legal and acceptable purposes, as authorized in these Terms of Service. You will not use, permit to use or assist others in using, our Services in ways that: (a) violate or infringe the rights of Treebal, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve sending illegal communications such as automated messages, automated calls or illegal unsolicited communications.

The user is solely responsible for the contents transmitted by him/her by means of the Treebal Services and undertakes to refrain from using the Treebal Services for disseminating messages of an offensive, insulting, disparaging, degrading nature or that could affect the proper functioning of the Treebal Services or infringe the privacy of other users. The user agrees not to use the Treebal Services to harm minors in any way whatsoever, in particular by disseminating messages of a violent or pornographic nature or of a nature that could prejudice human dignity. The user must refrain from disseminating any pornographic, racist or illegal content that may cause harm to other users or to Treebal's brand image through provocative messages, texts or images.

In general, the user agrees not to use the Treebal Services to disseminate any message, image or information:
  • contrary to public order;
  • offensive, defamatory, racist, xenophobic, revisionist or damaging to the honor or reputation of others;
  • inciting hatred or discrimination against a person or group of persons on the basis of their sex, origin or membership or non-membership of a particular ethnic group, nation, race or religion;
  • threatening a person or group of persons;
  • of a pornographic, pedophile or zoophile nature;
  • inciting to commit a crime, violent acts, an act of terrorism or advocating war crimes or crimes against humanity;
  • inciting suicide;
  • allowing third parties to obtain directly or indirectly counterfeited software, software serial numbers, software allowing acts of piracy and intrusion into computer and telecommunications systems, viruses and other logic bombs and generally any software or other tool that may infringe the rights of others and the safety of persons and property.

No Harm to Treebal. You must not, and must not permit others to, access, use, modify, distribute, transfer, or exploit the Treebal Services in unauthorized manners, or in ways that would harm Treebal, the Treebal Services, or the related systems. For example you must not (a) gain or try to gain unauthorized access to the Treebal Services or underlying systems; (b) disrupt our systems or affect the integrity or performance of the Treebal Services; (c) create accounts for the Treebal Services through unauthorized or automated means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or otherwise charge for the Treebal Services.

Keeping Your Account Secure. The Treebal Services embrace privacy by design and Treebal does not have the ability to access your messages and communications as they benefit from end-to-end encryption. However, you are responsible for keeping your device and your Treebal account safe and secure. The user is solely responsible for his login and password and for the use of said credentials. If you lose your phone, follow the steps on our Support site to re-register for the Treebal Services. When you register with a new device, your old device will stop receiving all messages and calls.

The user of the Treebal Services is solely responsible for the consequences of any communication by the user of passwords, confidential codes and in general of any information deemed sensitive or confidential, using the Treebal Services. Treebal shall not be held liable in the event any legal proceedings are initiated against the user as a result of the use of the Treebal Services.

No Access to Emergency Services. The Treebal Services do not provide access to emergency service providers like the police, fire department, hospitals, or other public safety organizations. Make sure you can contact emergency service providers through a mobile, fixed-line telephone, or other service.

Third-party services. The Treebal Services may enable you to access, use, or interact with third-party products and services including websites, apps or other content. Please keep in mind that when you use third-party products and/or services, their terms and privacy policies govern your use of those products and/or services.

Your rights and license with treebal

Your Rights. You own the information you submit through the Treebal Services. You must have the rights to the phone number you use to sign up for your Treebal account. For all data protected by intellectual property rights, you must obtain the relevant prior authorization from the holders of the rights under the applicable legal conditions before communicating such data by using the Treebal Services, and in particular before any reproduction, representation and/or communication to the public.

Treebal’s Rights. We own all copyrights, trademarks, domain names, logos, trade dress, trade secrets, patents, and more generally all intellectual property rights associated with the Treebal Services. You may not use our intellectual property rights unless you have our prior written permission. By using the Treebal Services, the user does not acquire any right whatsoever over the Treebal trademark or any of the intellectual property rights of Treebal. Treebal’s License to You. Treebal grants you a limited, revocable, non-exclusive, and nontransferable license to use the Treebal Services in accordance with these Terms of Service.

Disclaimers and limitations

Disclaimers. We will use reasonable skill and care for providing the Treebal Services to you and form maintaining them as a safe and secure environment. However, we do not guarantee that the Treebal Services will function without any interruption, delay or defect. The Treebal Services should not be considered as a data hosting service and you remain responsible for storing and safeguarding with other products or services any data any data you communicate or receive by means of the Treebal Services. To the extent legally permissible, you agree that we provide the Treebal Services to you on an "as is" basis without any express or implied warranties, including, but not limited to, fitness for a particular purpose, non-infringement, and freedom from computer virus or other harmful computer code.

Limitation of liability. To the extent legally permissible, our aggregate liability to you resulting from a breach of these Terms of Service shall be limited to direct losses that are a reasonably foreseeable consequence of such breach and will not exceed the greater of (i) the amount you have paid us in the twelve months preceding the first event triggering our liability and (ii) one hundred Euros (EUR 100) - except in relation to personal injury, gross negligence and willful misconduct.

Availability of Our Services. We do not guarantee that the Treebal Services will be uninterrupted, and the Treebal Services may be modified discontinued at any time, in part or as a whole. In particular, our services may be interrupted, including for maintenance, upgrades, for network or equipment failures or if a force majeure event occurs.

Content accessed through the Treebal Services. The pictures, graphics and/or information (including location, name, age) provided by the users and available through the Treebal Services are provided by the relevant users under their own responsibility and are not necessarily accurate.

Location-based functionalities. Provided you consent to the processing of your location, geolocation functionalities may be used to display within the Treebal Services places close to those of the user for illustrative purposes. The content provided to you on the basis of your location data has no contractual value.


Termination of the Treebal Services. You may terminate these Terms of Service and the use of the Treebal Services at any time by deleting the Treebal application from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of the Treebal Services anytime for unlawful conduct or if you violate our Terms of Service.

Update of the Terms of Service. Treebal may update these Terms of Service from time to time. We will inform you in advance of any such updates. Your continued use of the Treebal Services once the updated version of the Terms of Service becomes effective confirms your acceptance of the updated Terms of Service.

Severability. If a provision in the Terms of Service is deemed void, unlawful or unenforceable, that provision shall be considered severable from the Terms of Service and shall not affect the enforceability of the remaining provisions.

Compliance with laws. You must comply with all applicable export control and trade sanctions laws. The Treebal Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. We reserve the right to limit the Treebal Services in any country.

Governing law. These terms of service are governed by the laws of France, excluding its conflict of law rules.

Consumer information. Treebal does not and will never use or provide your phone number to third parties for marketing purposes. Without prejudice to the foregoing and pursuant to the requirements of the Consumer code, we hereby inform you that, if you are a consumer, you are generally entitled to register on a list to object to the use of your phone number for marketing solicitation purposes.

Dispute Resolution and Jurisdiction. If you are a consumer, you have a right to trigger the mediation procedure provided in article L. 611-1 of the Consumer Code to solve a dispute with Treebal relating to the Terms of Service. In addition, to the extent legally permitted, all disputes relating to the Terms of Service must be referred to the exclusive jurisdiction of the courts of Rennes (France), including in the event of plurality of defendants, third party claims or summary proceedings.
